How Are Parental Rights Affected When One Parent Lives Outside Indonesia?

Living outside Indonesia does not automatically cause a parent to lose custody, access, or responsibility for their child. However, it can affect custody decisions, contact with the child, and disputes over whether the child should remain in Indonesia or move overseas.

Can a Parent Living Abroad Still Have Access to the Child?

Custody and access are separate issues. For Muslim custody cases, Supreme Court guidance requires a custody order to give the parent who does not have custody access to the child. Denying that access can also provide grounds for asking the court to revoke the existing custody arrangement.

When one parent lives outside Indonesia, contact may involve visits when the overseas parent is in Indonesia, longer periods during school holidays, communication while the parent is abroad, or agreed visits overseas. The arrangements should reflect the child’s circumstances and any court decision that applies.

Can the Child Move Overseas with One Parent?

Moving a child to another country can become a custody issue if the move affects an existing custody arrangement, the child’s relationship with the other parent, or access granted by a court.

A parent should not assume that having custody allows them to ignore an existing court order or the other parent’s court-granted access when taking the child abroad.

When deciding a custody dispute, a court can consider where the child lives, who provides day-to-day care, the child’s stability, and whether the proposed arrangement can work in practice. In one Muslim custody case, the Indonesian Supreme Court considered the mother’s frequent overseas travel and uncertainty over who would care for the child during her absence when awarding custody to the father. This does not create a general rule against parents who live abroad.

Does Living Abroad Affect Child Support Obligations?

A parent may still have to support the child even when the child lives with the other parent and regular physical contact is difficult because they live in different countries.

Under Indonesian law, both parents continue to have responsibilities toward their children after divorce. For Muslim divorces, the father generally bears the child’s maintenance costs according to his ability.

Living overseas can make payment and enforcement more difficult, but it does not end the responsibility to support the child.

What Happens if There Is Already an Indonesian Custody Order?

An existing Indonesian custody or access order does not stop applying simply because one parent moves abroad. If an overseas move conflicts with the order or interferes with court-granted access, the parent should not assume that relocation allows them to disregard those terms.

If circumstances have changed significantly, a parent may need to ask the court to change the existing custody or access terms.

What Should a Cross-Border Custody Arrangement Cover?

A cross-border custody arrangement may need to state where the child will mainly live, when the child can spend time with the overseas parent, what happens during school holidays, who handles travel arrangements and costs, and how the child will communicate with the overseas parent between visits.

The parents may also need to address what happens if either parent later wants the child to move to another country.
