Can You Claim Financial Support While Your Indonesian Divorce Is Still Ongoing?

A spouse can ask an Indonesian court to address financial support before the divorce is final. This can include support for the wife and financial arrangements for the couple’s children while the case is still being heard.

Can the Court Order Financial Support Before the Divorce Is Final?

While divorce proceedings are ongoing, either spouse can ask the court to determine the financial support the husband must provide. The court can also make arrangements for the maintenance and education of the children.

This can be important when the spouses have already separated and the husband has stopped or reduced financial support. Starting divorce proceedings does not, by itself, end the husband’s existing maintenance obligations. However, a spouse seeking a specific support order should raise the issue during the proceedings.

Does Financial Support Differ Between Muslim and Non-Muslim Divorces?

The court handling the divorce depends on the couple’s religion. Muslim divorces are generally handled by the Religious Court, while non-Muslim divorces are handled by the District Court.

The general rules allowing the court to address financial support while divorce proceedings are ongoing are not limited to Muslim couples.

For Muslim couples, additional financial concepts may apply. A wife may claim nafkah madhiyah, meaning maintenance that the husband should have paid earlier. Past child maintenance may also be claimed where the father failed to provide it.

The procedure also differs depending on whether the husband files for cerai talak or the wife files for cerai gugat. A wife does not automatically lose her financial rights because she filed for divorce.

What Will You Need to Show the Court?

The amount requested should reflect the family’s financial circumstances.

Bank statements and previous transfers can show the level of support the husband provided during the marriage. Rent, household expenses, school fees, medical costs, and other records can show the expenses that continue while the divorce is pending. Evidence of the husband’s salary, business income, or other financial resources may also be relevant where available.

There is no single amount that applies to every case. The court can consider the husband’s financial capacity together with the needs of the wife and children when deciding the amount.
