Divorce is the termination of the relationship between a husband and wife based on the decision of a judges carried out through a series of trial processes.
In Indonesia, divorce through a trial process can only be carried out by husband and wife whose marriage is registered in accordance with applicable regulations. Divorce can be filed either in district court or in religious court, this is determined by the religion of the couple who will submit the divorce process. If the person wishing to divorce is Moslem, then the divorce process is submitted to the religious court (Pengadilan Agama) where the respondent/defendant is domiciled, and if the person wishing to divorce is not a Moslem, then the divorce process is submitted to the district court (Pengadilan Negeri) where the defendant is domiciled.
