What Happens to Your Immigration Status When a Marriage Is Disputed in Indonesia?

A dispute over the validity of a marriage can affect a foreign spouse’s immigration status in Indonesia when the marriage is the legal basis for their stay permit. A challenge alone does not necessarily end that status; the immigration consequences depend on the legal outcome of the dispute and the permit held.

When Does Immigration Status Depend on the Marriage?

The issue primarily affects foreigners holding a stay permit based on marriage to an Indonesian citizen. The marriage forms part of the legal basis for their residence in Indonesia.

A foreigner staying in Indonesia on an independent basis, such as employment or investment, does not generally depend on the marriage to maintain that particular immigration status.

An allegation that a marriage is invalid, improperly registered, or otherwise legally defective does not by itself establish that the marriage has ceased to have legal effect. If a court or other competent authority reaches a decision affecting the marriage, Indonesian immigration authorities may then need to determine whether the foreign spouse can keep a stay permit issued on the basis of that marriage.

How Does a Dispute Over the Marriage Affect the Existing Stay Permit?

If a court or other competent authority reaches a decision that affects the marriage, the consequences can extend to a stay permit issued based on that marriage. Indonesian immigration authorities may then need to determine whether the foreign spouse can keep their existing stay permit.

Can the Foreign Spouse Remain in Indonesia on Another Basis?

If the marriage can no longer support the existing stay permit, the foreign spouse may qualify for another immigration status through employment, investment, or another available type of stay permit.

Eligibility depends on the requirements for the new status. A foreigner cannot rely on a possible alternative until the necessary immigration requirements have been met.

Does Holding a KITAP Change the Position?

A foreign spouse holding a permanent stay permit, or KITAP, can be in a different position from someone holding a temporary marriage-based stay permit.

Indonesian immigration rules allow some foreign spouses to retain a marriage-based KITAP after the marriage ends. Where the marriage lasted 10 years or more, the KITAP can remain valid subject to the foreigner having an Indonesian guarantor. Where the marriage lasted less than 10 years, the KITAP may also remain valid if an Indonesian guarantor is appointed and reported to the relevant immigration office within the required period.

These rules primarily address the end of a legally recognized marriage, including through divorce or a court decision. A claim that the marriage itself was never legally valid raises a different question because it can challenge the basis on which the marriage-related immigration status was originally obtained.

If a court decision affects that basis, Immigration may need to determine separately whether the existing KITAP can continue. The terms of the decision, the foreigner’s marriage records, and the basis on which the KITAP was issued can affect that assessment.
