Mixed Marriages for Non-Muslims in Indonesia

Foreign–Indonesian couples who are not Muslim can legally marry in Indonesia when the ceremony is performed under a shared non-Islamic faith and registered with the Civil Registry (Catatan Sipil). A marriage conducted without registration has no legal standing.

Indonesia’s Marriage Law requires that the marriage follow the religious laws of both partners, which in practice means the couple must share the same religion at the time of marriage so the ceremony can be conducted under one recognized authority.

    Required Documentation

Both partners must prepare complete documentation before the ceremony. The foreign partner requires a Certificate of No Impediment (CNI) or an equivalent document from their embassy, confirming their legal eligibility to marry.

The Indonesian partner must provide a birth certificate, national ID (KTP), and family card (Kartu Keluarga). Where applicable, divorce or death certificates of previous spouses must also be included.

All foreign documents must be translated into Bahasa Indonesia by a sworn translator and legalized or apostilled before submission to local authorities. Missing or uncertified documents are the most frequent causes of delays and rejection.

    Registration And Recognition

After the ceremony, the couple must register their marriage at the local Civil Registry within 60 days. The registration produces an official marriage certificate, known as the Akta Perkawinan, which confirms the marriage’s legal validity in Indonesia. This certificate is essential for immigration, property ownership, and inheritance matters.

If the marriage takes place overseas, it can still be recognized in Indonesia by registering the foreign marriage certificate within 30 days of returning to the country. Recognition depends on whether the marriage was valid where it was performed and whether both partners were legally eligible to marry under Indonesian law. Registering on time avoids administrative complications and ensures full legal standing for the couple in Indonesia.

Once the marriage is registered, it becomes the legal foundation for residence and family rights in Indonesia.

    Immigration And Family Status

A registered marriage enables the foreign spouse to apply for a spouse-sponsored residence permit (KITAS) and later for permanent residency (KITAP). The Civil Registry certificate serves as the foundation for these applications. Children born to non-Muslim mixed marriages may hold dual nationality until the age of 18, at which point they must choose one citizenship under current regulations.

Proper registration ensures both parents and children enjoy full legal protection, including rights to residence, education, and family representation in Indonesia.

    Property And Asset Planning

Indonesian law prohibits foreigners from owning freehold land. Without a prenuptial or postnuptial agreement, assets acquired during marriage are presumed to be joint property, which can jeopardize the Indonesian spouse’s right to hold land titles. A notarized prenuptial or postnuptial agreement clarifies financial and inheritance rights for both parties.

Couples intending to buy property or invest in Indonesia should finalize this agreement before marriage registration or soon after.
