How Is an Overseas Spouse Summoned in an Indonesian Divorce?

An Indonesian divorce can still proceed when one spouse lives outside Indonesia, but the overseas spouse must first be properly summoned. The procedure depends partly on whether the spouse has a known overseas address or verified electronic domicile.

How Does an Indonesian Court Summon a Spouse Overseas?

Indonesia’s electronic court rules allow a party living overseas to be summoned electronically when their electronic domicile is known. PERMA No. 7 of 2022 provides the framework for this procedure. If the electronic domicile is unknown or cannot be verified, another applicable summons procedure must be used.

Where cross-border service is required, the court may need to use the procedure for delivering Indonesian judicial documents overseas. This can involve additional administrative and international channels before the summons reaches the spouse.

What Information Is Needed to Summon an Overseas Spouse?

The information needed will depend on how the spouse can be reached. A complete overseas address can be important when court documents need to be delivered through the applicable cross-border procedure, while an electronic address may be relevant in determining whether electronic summons can be used.

Other available information, such as the spouse’s last known address, employment details, telephone number, email address, family information or previous communications, may help establish where the spouse can be reached.

How Does Overseas Service Affect the Divorce Timeline?

An Indonesian divorce involving an overseas spouse can take longer because the court may need to use additional procedures to deliver the summons and confirm that it has been handled.

The destination country can also matter. Indonesian courts have received specific guidance for countries where the normal cross-border delivery mechanism is unavailable because of operational restrictions, government policies or other circumstances. In these situations, the court must consider another legally permitted method of summons.

What Happens If the Overseas Spouse Does Not Respond?

There is an important difference between a spouse who cannot be properly summoned and one who has been properly summoned but does not participate.

A spouse cannot necessarily prevent an Indonesian divorce simply by remaining overseas or refusing to respond. Once the court is satisfied that the required summons procedure has been followed, the case may be able to continue despite that spouse’s absence.

However, failure to participate does not automatically mean that the divorce will be granted. The court must still consider whether the requirements for granting the divorce have been met.

The key issue is whether the absent spouse was given a legally sufficient opportunity to participate in the proceedings.

What If the Overseas Spouse’s Address Is Unknown?

Supreme Court guidance issued in August 2026 confirms that knowing a spouse’s country or general location does not necessarily mean their residence is known for summons purposes. Knowing that someone lives in Australia, for instance, is different from having an address where court documents can be delivered.

If only the country or general area is known, the available information should first be assessed to determine whether a usable residential address or verified electronic domicile can reasonably be identified.

A spouse should not automatically be treated as having unknown whereabouts simply because their exact overseas address is unavailable. The circumstances and available information need to be considered before determining the appropriate summons procedure.

Public notification should also not automatically be treated as the first solution whenever an overseas address is incomplete. The appropriate procedure depends on the circumstances and the court’s determination.

Can an Overseas Spouse Participate in the Divorce from Abroad?

Receiving a summons abroad does not necessarily require the spouse to return to Indonesia. Depending on the proceedings, an overseas spouse may be represented by an Indonesian lawyer, subject to the applicable procedural requirements.

However, overseas service does not mean that every stage of the divorce can automatically be completed remotely. Whether personal participation is required will depend on the proceedings and the court.
