Mix Marriage Divorce

Based on Article 57 of Law Number 1 of 1974 concerning Marriage, a mixed marriage is:

“a mixed marriage is between two people who in Indonesia are subject to different laws, due to differences in nationality and one of the parties is an Indonesian citizen.”

For mixed marriage couples, there are quite a few who held their marriage outside Indonesia, so the marriage is not yet legal and has not been recognized under Indonesian law. In order for a mixed marriage to be legal and recognized under Indonesian law, couples who held their marriage outside Indonesia are required to register their marriage to civil registration in Indonesia no later than 30 days after the person returns to Indonesia.

Divorce for mixed marriages can only be carried out or submitted to either the district court or religious court after the mixed marriage is officially registered in Indonesia.
