What Happens to a Prenup If One Spouse Becomes Bankrupt in Indonesia?

A spouse becoming bankrupt does not automatically make a valid prenup invalid in Indonesia. If the prenup separates the couple’s property, assets belonging to the non-bankrupt spouse may remain outside the bankruptcy estate — the assets available to pay creditors.

How Does the Prenup Affect the Bankruptcy Estate?

Under Indonesia’s general marital property rules, property acquired during marriage is generally treated as joint property unless the spouses have established a different arrangement. If the spouses have joint property, the bankruptcy of one spouse can affect that property.

The prenup itself may not be enough to establish ownership. Documents showing when an asset was acquired, who paid for it, and who owns it may become important if the bankruptcy administrator or a creditor dispute whether it belongs to the bankrupt spouse.

When Can Creditors Challenge the Protection?

Indonesian bankruptcy law allows certain transactions made before bankruptcy to be challenged if they harm creditors’ ability to recover what they are owed.

The bankruptcy administrator may examine transfers between spouses where there is reason to believe assets were moved out of the debtor’s ownership before bankruptcy.

What If the Other Spouse Signed or Guaranteed the Debt?

A prenup generally cannot remove a financial obligation that the non-bankrupt spouse personally took on.

The foreign spouse may have jointly signed a loan, personally guaranteed a business loan, or used their own asset as security. These obligations can apply regardless of how the prenup separates the couple’s property.

If a lender required personal guarantees in connection with an Indonesian business, the relevant guarantee must therefore be considered separately from the prenup.
